Gender-based violence is a common element of conflict and authoritarian regimes, and impunity for violations against women in these contexts is pervasive. At the same time, women are often absent or underrepresented in criminal and transitional justice efforts. Recent examples of truth commission mandates, judicial opinions, and reparations programs have shown little regard for the distinct and complex nature of gender-based violations, and there has been limited success in prosecuting crimes of gender violence at the domestic or international level. Amrita Kapur, Senior Associate in the International Center for Transitional Justice’s Gender Justice Program, will discuss some of the gender-specific challenges in criminal justice, and how these are related to broader gender issues in transitional justice.
