Seeking Justice for the 2007-2008 Post Election Crimes in Kenya

Following the 2007-2008 disputed presidential elections, Kenya was engulfed in violence that lasted for several months. During this time, thousands of people were displaced, killed and raped. Since the violence ended, survivors and victims’ families have been seeking justice and reparations for the human rights violations they suffered. In 2011, the International Criminal Court (ICC) indicted the current President Uhuru Muigai Kenyatta and Deputy President William Samoei Ruto for crimes against humanity committed during the post election violence. In December 2014 the charges against President Kenyatta were withdrawn and in April 2016 the case against Deputy President Ruto was terminated. This was a major set back for many survivors and families of victims who had hoped to see justice served by the ICC. Currently, the hope of survivors to rests on two domestic public interest litigation cases.

Eva Nudd will discuss the litigation that aims to hold the government accountable for sexual and gender based crimes committed and indiscriminate police shooting following the elections. Ms. Nudd will outline how these cases seek to address the Kenyan government’s failure to protect people from, prevent and effectively investigate the violence and crimes committed following the elections.

Eva Nudd is a human rights advocate with vast experience in gender issues and international criminal law. She is currently working as a consultant for Open Society Justice Initiative assisting in public interest litigation cases seeking justice for human rights violations stemming from the 2007-2008 Post-Election Violence in Kenya. Previously, Ms. Nudd worked an immigration attorney in New York assisting individuals from Middle East and Africa to obtain asylum status in the United States. Previously, Ms. Nudd spent summer in Kenya working on the police vetting, reparations and sexual and gender based crimes with the International Center for Transitional Justice in Kenya. She also worked as a fellow with the Open Society Justice Initiative where her portfolio included legal and technical assistance to the International Criminal Court and on a prosecution of Radovan Karadzic at the International Criminal Tribunal for the Former Yugoslavia.
